Version of 27 October 2026
Terms of use of PosXT
The contract between your business and PosXT: the till, the owner dashboard and the related services.
These terms apply to the PosXT service: the PosXT Caisse till software installed in your business, the online owner dashboard (app.posxt.com) and the related services (synchronisation, backups, e-mails, support). They form the contract between your business and [company name], which operates PosXT (“PosXT”). By using the service, you accept them on behalf of the business you represent. They are supplemented by the privacy policy and the legal notice. The French version is the reference text.
1. The service
PosXT is point-of-sale software that works without an internet connection in the shop. Sales are recorded on the till, then sent to the owner dashboard as soon as the connection returns. Mobile money payments (Wave, Orange Money, Free Money) are recorded with the transaction reference entered by the cashier: the till does not connect to the operators and does not confirm payments. The features available depend on the plan agreed.
2. Your account
- Your business’s account is opened by the PosXT team after a first contact; there is no online sign-up. The till is installed with our team.
- You provide accurate information (business name, NINEA and RCCM, name, e-mail address) and keep it up to date.
- Access for the owner and managers is protected by a password and mandatory two-factor authentication. You keep these credentials, the till PIN codes and the recovery codes confidential, and you are responsible for any action taken with them.
- Tell us straight away at support@posxt.com if you think an access has been compromised.
3. Plan, subscription and payment
- The plan, the length of any trial and the subscription price, in CFA francs (XOF), are set out in the proposal we send you before the account is opened.
- Invoices are issued by PosXT and payable within the period stated on the invoice.
- If an invoice is unpaid, a grace period applies, after which the account may be suspended. The till remains usable to view and export your data.
4. Your data
- Your business’s data (sales, products, customers, staff) belongs to you. For the personal data of your customers and staff, you are the controller and PosXT acts as processor, solely to provide the service and on your instructions.
- You are responsible for the lawfulness of the data you enter under Law No. 2008-12 of 25 January 2008 on the protection of personal data and its implementing Decree No. 2008-721, and for the formalities with the Personal Data Protection Commission (Commission de protection des données personnelles, CDP) that fall to you: declaring the processing and requesting authorisation to transfer data outside Senegal. On request, we provide a data processing agreement and the information you need for this file.
- Synchronised data is hosted outside Senegal, in Frankfurt (Germany, European Union). The till’s data stays encrypted on the shop computer.
- You can export your data at any time from the till. Your customers’ requests for access, rectification or deletion are handled with the till’s privacy tools; accounting records are kept for as long as the law requires.
- PosXT accesses a business’s data for support only with the owner’s agreement, and does not connect remotely to your till unless invited.
5. Your obligations as a merchant
PosXT helps you run your till, but you remain responsible for your tax and accounting obligations (returns, keeping records, legal details on your receipts and invoices). Check the VAT settings and your business’s NINEA, RCCM and other legal details in the till.
6. Availability and support
- The till keeps selling without the internet. The online owner dashboard and synchronisation may be interrupted for maintenance or in the event of an incident; we do our best to keep these interruptions short and to warn you.
- Keep the till computer up to date, protected and backed up. Backups do not replace your own care (theft, hardware failure).
- Support can be reached at support@posxt.com.
7. Prohibited use
You may not use PosXT for an unlawful activity, try to access another business’s data, circumvent the service’s protections or resell it without written agreement.
8. Liability
PosXT is provided with care and in line with good professional practice. Our liability is limited to direct and proven damage, up to the amounts paid for the service in the previous twelve months, except in the case of gross negligence or where the law provides otherwise.
9. Termination
You can end your subscription at any time by writing to us; it ends at the close of the period paid for. Export your data before the account is closed. PosXT may suspend or close an account for non-payment or a serious breach of these terms, after warning you except in an emergency.
10. Changes to these terms
We may update these terms. Any significant change is announced to you by e-mail or in the owner dashboard at least 30 days before it applies.
11. Governing law
These terms are governed by Senegalese law, including the OHADA Uniform Acts applicable between traders. In the event of a dispute, we first seek an amicable solution; failing that, the competent courts of Dakar have jurisdiction.
